1. Acceptance of Terms
By accessing or using the downtime.ad service ("Service"), including the website at downtime.ad, the API at api.downtime.ad, and the iOS application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
By creating an account or using the Service, you represent that you have read, understood, and agree to be bound by these Terms. These Terms constitute a legally binding agreement between you and downtime.ad.
2. Service Description
downtime.ad is an uptime monitoring service that allows users to monitor the availability of websites, APIs, and other URL-based endpoints. The Service includes:
- Automated periodic checks of user-specified URLs to determine availability and response times.
- Instant push notifications delivered to iOS devices when a monitored URL goes down or recovers.
- An iOS application to manage monitors, view uptime history, and receive alerts.
- A backend API that processes monitoring tasks, manages accounts, and delivers notifications via Apple Push Notification service (APNs).
The Service is designed to provide informational monitoring data and should not be used as the sole means of ensuring the availability of critical systems.
3. Account Registration
To use the Service, you must create an account by providing a valid email address and a password. You agree to:
- Provide accurate and complete registration information.
- Maintain the security and confidentiality of your login credentials.
- Accept responsibility for all activities that occur under your account.
- Notify us immediately at hello@downtime.ad if you suspect any unauthorized use of your account.
You must be at least 16 years of age to create an account and use the Service. By registering, you confirm that you meet this age requirement.
downtime.ad reserves the right to refuse registration, suspend, or terminate accounts at its discretion.
4. Free Plan
downtime.ad currently offers a free plan that includes:
- Up to 5 monitors per account.
- URL checks at 5-minute intervals.
- Push notifications for downtime and recovery events.
- Uptime history and response time tracking.
The features, limits, and availability of the free plan are subject to change at any time, with or without prior notice. We may introduce paid plans, modify existing limits, or adjust the scope of the free offering as the Service evolves. Continued use of the Service after any such changes constitutes acceptance of the updated terms.
5. Acceptable Use
You agree to use the Service responsibly and in compliance with all applicable laws. The following activities are strictly prohibited:
- Illegal URLs: Monitoring URLs that host, distribute, or promote illegal content, including but not limited to piracy, fraud, or malware distribution.
- API abuse: Sending excessive, automated, or scripted requests to the downtime.ad API beyond normal usage patterns, including attempts to overload or disrupt the Service.
- Reverse engineering: Decompiling, disassembling, reverse engineering, or attempting to derive the source code of the Service, its API, or any related software.
- Circumvention: Attempting to bypass rate limits, account restrictions, or any security measures implemented by the Service.
- Resale: Reselling, redistributing, or sublicensing access to the Service without prior written consent.
- Interference: Any action that interferes with, disrupts, or places an unreasonable burden on the Service or its infrastructure.
We reserve the right to determine what constitutes a violation of these acceptable use terms and to take appropriate action, including account suspension or termination.
6. Intellectual Property
The Service, including its software, design, branding, logos, documentation, and all associated intellectual property, is owned by downtime.ad and is protected by applicable intellectual property laws.
You retain ownership of any data you submit to the Service (such as URLs and account information). By using the Service, you grant downtime.ad a limited, non-exclusive license to use this data solely for the purpose of providing the Service to you.
Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.
7. Service Availability
downtime.ad is provided on a "best effort" basis. We strive to maintain high availability and reliability, but we do not guarantee uninterrupted or error-free operation of the Service.
Specifically:
- There is no Service Level Agreement (SLA) for the free tier. We do not guarantee any specific uptime percentage.
- The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
- We may modify, suspend, or discontinue any part of the Service at any time, with reasonable notice when possible.
- Push notification delivery depends on Apple Push Notification service (APNs) and device connectivity, which are outside our control.
8. Limitation of Liability
The monitoring data and notifications provided by downtime.ad are informational only. The Service is not intended to replace professional infrastructure monitoring systems for mission-critical applications.
To the maximum extent permitted by applicable law:
- downtime.ad shall not be liable for any missed alerts, delayed notifications, or failure to detect downtime of your monitored URLs.
- downtime.ad shall not be liable for any losses, damages, or costs arising from your reliance on the monitoring data provided by the Service.
- downtime.ad shall not be liable for any indirect, incidental, special, consequential, or punitive damages, regardless of the cause of action.
- Our total cumulative liability for any claim arising from or related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or ten euros (EUR 10), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain types of liability. In such cases, our liability shall be limited to the fullest extent permitted by applicable law.
9. Termination
By us: We reserve the right to suspend or terminate your account, without prior notice, if we determine in our sole discretion that you have violated these Terms, engaged in abusive behavior, or are using the Service in a manner that threatens the integrity or availability of the platform for other users.
By you: You may delete your account at any time through the iOS application. Upon deletion, your account data, monitors, and notification history will be permanently removed from our systems in accordance with our Privacy Policy.
Termination does not relieve you of any obligations incurred before the effective date of termination. Sections regarding intellectual property, limitation of liability, and governing law shall survive termination.
10. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal data.
By using the Service, you acknowledge that you have read and understood our Privacy Policy and consent to the data practices described therein. Key points include:
- We collect only the data necessary to provide the Service (email, monitored URLs, device tokens for push notifications).
- We do not sell your personal data to third parties.
- Data is stored securely and transmitted over encrypted connections.
11. Modifications to Terms
We reserve the right to update or modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page.
For significant changes, we will make reasonable efforts to notify you, such as by posting a notice within the iOS application or sending a notification to the email address associated with your account.
Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the revised Terms. If you do not agree with the changes, you should stop using the Service and delete your account.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Principality of Andorra, without regard to its conflict of law provisions.
Any disputes arising from or related to these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts of the Principality of Andorra.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
